Halburn Now Terrorizing Judicial System

In a case that can have implications for anyone (Halburn) that gets his only "original" stories by regurgitating documents faxed to him from Putnam County Magistrate Court, Halburn has filed a complaint with the state "Judicial Review Commision" (sic).
Halburn claims he filed a complaint with the WV
"Judicial Review Commision" (sic), whatever that is. As far as we can tell there is no such animal.
In an article strangely written by him in the third person, and going so far as to actually quote himself, Halburn claims a court policy that requires a $2 per page charge for faxed documents is illegal.
The Putnam County Magistrate Court is refusing to fax Halburn documents because he is too cheap to pay the $2 fee.
What is it about the law that you don't understand, crisco? What are you, a retard?Here's what the law says:

West Virginia Code
§29B-1-3(5) The public body may establish fees reasonably calculated to reimburse it for its actual cost in making reproductions of such records.

He fails to understand what actual cost is. It's more than just the cost of a piece of paper or some toner. He actually believes that there is
there is NO COST to the magistrate court to send a fax to him.

Humans are an actual cost.

Human labor is an actual cost.
If you pull a clerk off their job for an hour to pull your records, you're preventing them from doing their job, which has an actual cost to the county, etc.

The county is not operating a personal wire service to feed you news, no matter what you may think, liver lips.

This is all part of your mental defect.
Your mental retardation requires you to take everything literally.
Halburn whines that magistrate courts only charge 50 cents a page when you pick up a document in person, but they charge $2.00 a copy to fax them.

Why?
Maybe it's because when you go in person, they make a copy and hand it to you. When you have it faxed, they have to get the documents, make a copy, take it to a fax machine, dial the number, and make sure everything transmits properly. Looks like about four times the work to us. The costs are neither excessive nor prohibitive.

You have a right to the information and they have a right to charge for it. It's as simple as that.
A business that makes all the money that you says it does should easily be able pay $2 a page.

Regardless, nobody is denying you the documents. You're free to go look at them and copy them yourself. Your issue is about the delivery not the access.

Here's a money saving solution for you, you cheap bastard: Get off your fat ass, and drive the 12 miles over to the courthouse and save yourself $1.50.

Antics
like yours and your fat little toady, Jay Lawrence Smith, actually make it harder for the public and the media to get access to documents. The Freedom of information act is not a license to do whatever you want.

Supreme Court Administrative Director Steve Canterbury says in the letter to Putnam County Magistrate Court, " I know some news people can be very insistent, even demanding that they be treated differently than the typical citizen. Sometimes that insistence has been known to turn into belligerence, and it is certainly no fun to be on the receiving end of such abuse. If such interactions ever turn too ugly for you to tolerate, then please don't. Call the sheriff's office if no other reasoning works with the belligerent individual."

Is Halburn being singled out? Maybe. But who cares?
If he weren't such an obnoxious asshole to everyone, the court probably wouldn't need this rule and probably wouldn't be charging him. Obviously he never heard the saying, "You catch more flies with honey than vinegar."

This is just one more in a long line of complaints that he's going to lose.

  2. The $2 fee is a convenience fee. You're paying for the convenience. It's always cheaper to pick up a pizza than have it delivered; cheaper to go to Borders than sometimes order off of Amazon.com.

  3. Like Hal(L)burn, I am not a real journalist, either, yet I can drive the 13.7 miles from my humble abode where my non-office is to the courthouse and get any information I want or need. Then again, I am willing to bet if I call and ask nicely, I can get them faxed to me for free, too...
