Halburn Continues To Attack Kelly

Hides Behind First Amendment

the third person, PutnumLIVE.com's out-of-state publisher Mark Hallburn continues to attack Kanawha County Family Court Judge Michael J. Kelly. 
Halburn is furious about a ruling that Kelly made on August 8th, 2012 forbidding him, after moving to South Carolina in March, from removing his son from the state.
Kelly is no doubt concerned that due to Halburn's past behavior, it is in the child's best interests to stay in West Virginia. He also realizes that Halburn is the type of vindictive prick that would kidnap his own son and disappear.
Halburn says, "Attention West Virginia parents, if you exercise your First Amendment rights, you could lose parenting rights with your children."
He claims that that due to his complaints about Kelly to the West Virginia Supreme Court he is being retaliated against.
Nothing could be further from the truth.
No one is trying to silence Halburn. He can say and write whatever drivel he pleases. He's already proved that.
But he must also be aware that his words have consequences. And that he will be held responsible for what he says.
Halburn has threatened, harassed and cajoled Kelly since Halburn's wife began divorce proceedings in November of 2011. Halburn has posted under at least 150 different names on the website Topix. All of those posts attack his enemies and support his own positions. He began attacking Kelly as soon as the case was assigned to him.
 
This has nothing to do with speech everything to do with actions.
In 1999 Halburn and his second ex-wife were flying back to California. Once on the plane, Halburn started complaining endlessly about the flight being late.
While he was taking one of several bathroom breaks, (no doubt so he could complain some more) the flight attendant told Mrs Halburn that if she didn't do something with him that they would both be removed from the flight at the next stop.
During the construction of the Hurricane Walmart, Halburn was arrested for telephone harassment after he called the construction supervisor over 10 times in one day and cursed at him over "excessive noise".
He was arrested after forcing his way into a closed public pool and continuing to swim after he was told to leave.
He was convicted of trespassing after another pool incident in Kanawha County. The boy was not present to witness any of those.
Halburn was involved in yet another pool incident at a Charlotte NC hotel in 2011 where he was escorted out for causing a disturbance. This was in front of the little boy.
He is persona non grata at the Comfort Inn in Barboursville after creating a disturbance in the lobby. He was ordered never to return there.
There have been numerous incidents in Putnam County as well where he has shown his ass while his son was with him. Especially involving pools and Joe Haynes.
This is the type of irrational behavior the judge is concerned about.
Hallburn says, "That's absurd, he lets me have my son inside the state. The risk is the same. Kelly's ego can't handle the fact that I complained about his bizarre rulings to Ketchum." He claims his son is being held hostage in West Virginia. Halburn continues, "My son can't go to the beach, the zoo, could not visit me on Father's Day. Kelly is treating my son like a second-class citizen and is violating his rights to enjoy life, liberty, and the pursuit of happiness."

Oh, he can do all those things. Just not with you, meathead.
The risk is that if Hallburn has his son and is arrested outside of West Virginia, the little boy will be without a guardian, hours from home. Therefore, Kelly ruled that the child must stay in West Virginia. And rightly so.

What Halburn doesn't like is that now, someone in authority is telling HIM what to do. And HIS ego can't take it.
And there's not anything he can do about it except whine about it. Endlessly.
What Halburn means by all this is that HIS ego can't handle the fact that he is no longer in charge of how he can interact with his child. And it's nobody's fault but his.
"Using my First Amendment rights to redress my government for grievances, I contacted Chief Justice Menis Ketchum, who asked me to prepare a motion," says Halburn. "I did, then he ordered me not to contact the court. Both of these so-called judges should be impeached for violating federal constitutional law."

What Halburn neglects to say is that he filed innumerable "motions" and followed those up with innumerable harassing phone calls to the Chief Justice, other Justices, administrators and employees of the Supreme Court, both at their offices and their homes.
THAT is why he has been ordered not to contact the Court any more.
Several years ago he was banned from even stepping foot on Supreme Court property.
Hallburn says he will be sending a Letter of Impeachment to Speaker Rick Thompson and the members of the West Virginia House of Delegates directing them to impeach Kelly and Ketchum as well as Putnam County Family Law Judge William Watkins.
Of course he will.
And he will follow up those letters with telephone calls. Lots of them.
They will ignore him and order Halburn not to contact them either.
Additionally, Hallburn wants Kelly removed because he ignored a motion providing evidence that his mother was dying, thereby not allowing her to see Halburn's son.

Halburn conveniently ignores the fact that his son is four years old. Halburn had plenty of opportunity to take the boy to see his Grandmother before she was knocking on death's door.
Halburn visited in January of this year. Without the boy. And before that in November of 2010. Again without the boy. If Halburn was so anxious for her to see her grandson, why didn't he attempt to take the boy until now?
Mark Halburn is a narcissistic sociopath. This is not about anyone but him.
His son is nothing more than a convenient crutch for his grievances.
It says a lot about a person that when his mother dies, the only thing he can think about is how a judge's ruling effects HIM.
Halburn believes those who disagree with him should be fired and jailed.
We're calling on Mark Halburn to do what he's done in other Family Court cases.
Release the videos of his divorce case.
 
ALL of the videos of his hearings before Judge Kelly. EVERY SINGLE MINUTE, not just “Cherry Pick” the portions that make the judge look bad.

We will see whether or not he takes the high road or continues with the low road.
You're the one calling for these hearings to be open to reporters and the public.

Put up or shut up, fatboy.

You want to know who is responsible for the court treating you this way, Halburn? Look in the mirror.
It's YOU, motherfucker.
Enjoy your supervised visits. Because that's where all this is heading.

  2. If he continues down this road, I doubt he will even get supervised visits. He will probably be considered a harmful parent (which he is) and his parental rights stripped (if they haven't already) and sole custody given to the second ex-wife.

    Hallburn is being seen as someone who will interfere with the care of that child and he being prevented from being anywhere near that kid. The kid is better off.

  5. How can someone be so off kilter and be allowed to walk the streets? If there was ever a text book case for a padded room somewhere, Halburn is it! He needs to be locked up for life. He is already a drain on society, so there would be no change there, just a safer, quieter community.

  7. "Stalking" probably wouldn't work, since the statute requires an element of "fear for safety" from the person. Halburn can only intimidate female clerks half his size - he doesn't have the cajones to threaten a grown man.

    On the other hand, the Legislature recently created a new statute allowing "personal safety orders" to be issued when there is cause to believe that a person may have committed a stalking-type offense (or a sexual offense, but unless there's a child and a camera involved we know Marky won't do that).

    A nice court order to stay away from various folks, under pain of criminal prosecution, might dissuade this goof.

    I've said it before - I'd pay well to watch his interactions on his first full day at Western Regional Jail.

  8. Halburn took the pictures this time. This was a day when he was supposed to pick up his son at 10 am.
    He took the pictures at 9:53 am.
    He warms up for browbeating his kid by doing a little stalking.
