GUILTY!!!

HALBURN CONVICTED!!!
SENTENCED TO 45 DAYS IN JAIL!!!

After a 2 hour trial on July 19, 2013 before Putnam County Magistrate Scot Lawrence, Mark Vance Halburn was found guilty of the willful disruption of government process and sentenced to 45 days in the Western Regional Jail.

On April 2, 2013, Halburn entered the Health Department offices and immediately became disruptive. After he refused to leave, a Deputy from the Putnam County Sheriffs office was summoned to the location. Halburn was arrested as he attempted to flee the scene.

Two weeks earlier, after Halburn had made numerous telephone calls to that office, he showed up and demanded access to the Department's administrator, Joel McKinney. Halburn was warned at that time by a Putnam County Deputy to leave and not return and was escorted off the property. Over the next couple of weeks Halburn continued to harass the Department's employees and administrator via email and telephone.

At the trial today, 4 witnesses testified against Halburn.

Administrator McKinney testified that Halburn was told that he was to come onto Department property only at a designated time.

Health Department employee Trena Smith testified that Halburn showed up at a time other than what was designated during the appointment time stated by McKinney.

Other testimony stated that Halburn was loud and abusive and that other customers could not do business while Halburn was in the office.

As usual Halburn is now going to file complaints against
Lawrence and every one else involved. And as usual, he is also blaming everyone but himself for his boorish behavior, claiming his First Amendment rights were violated and everyone is against him. Boo fucking hoo.

His sentence is stayed pending his appeal.

HALBURN ARRESTED AT HEALTH DEPARTMENT!!!

Publisher Harasses PCHD

Mark Vance Halburn
Mark Vance Halburn was arrested shortly before noon on Tuesday, April 3, at the Putnam County Health Department.

The sheriff's department says Halburn, who writes an internet blog, had been harassing the health department about Freedom of Information requests and was notified via email that the Department's Administrator, Joel McKinney, would only meet with him between certain hours. Halburn arrived there today outside of those hours and was arrested.

On March 18, after a similar incident, Halburn was ordered not to return or he would be arrested for trespassing.
This afternoon, Halburn returned, caused a disturbance and demanded to speak to McKinney. McKinney heard Hallburn shouting and causing a disturbance. McKinney attempted to explain to Halburn what he needed to do to get the information he wanted, but Halburn could not be calmed down. Hallburn’s actions caused other workers to stop working to see what was going on, made it difficult for them to wait on other people and made it difficult for computer maintenance work to be completed.
Halburn was unable to flee before Sheriff's Deputy C.M. Savilla arrived and took him into custody.

The obese, balding, slovenly Halburn, clad in cut off sweat pants and sandals, was taken before Chief Magistrate Kylene Brown and charged with violating WV code §61-6-19, willful disruption of government process. He was released on a personal recognizance bond and ordered to have no contact with the Health department.

Mark Vance Halburn is arraigned in Putnam County magistrate Court in front of the REAL media.
Magistrate Kylene Brown deals with domestic terrorist Mark Halburn.
This is Halburn's second arrest in the past six months. He was arrested in Kanawha County for making harassing  and obscene telephone calls in October 2012. He is currently serving a six month pre-trial diversion for that crime. One of the terms of that agreement is that he can't violate any Federal, state or local law. We will see how the Kanawha County Prosecutor's office handles this violation of that agreement.

Halburn was also arrested in 2009 after trespassing at a Kanawha County swimming pool. He was convicted on that charge in May 2010.

This is just another in a long line of incidents that Halburn has instigated. He will not take responsibility for any of them and for whatever reason he is rarely held accountable for them by the judicial system.

Halburn will have a hearing before Putnam County Magistrate Scot Lawrence on June 4 at 10:45 am.

Do I Get To Make An Opening Statement?

PutnamLIES.com's legal correspondent was present in court for Halburn's trespassing appeal.
We thought we'd recap some of the exchanges between Judge Kaufman and Halburn to demonstrate Halburn's legal brilliance.

Halburn (to Deputy Vernon): Why did you have your firearm when there's a sign that says no firearms?
Kaufman: What does that have to do with anything?
Halburn: Apparently he was breaking the law.
Prosecutor: He's authorized. He's a law enforcement officer.
Halburn: Is there an exclusion?
Kaufman: It doesn't matter! It's irrelevant!

Kaufman: Ever been to this pool before?
Halburn: No. I don't live in Kanawha County.

Kaufman: But you've been to other public pools?
Halburn: I've been to other public pools.

You've been to other public pools all right. The visit usually involves you leaving in handcuffs.

Kaufman: Hot August day. How many people would you say, in the middle of the afternoon, on a Saturday in August, were in the pool?

Halburn: A half dozen or more.
Kaufman: A half dozen or more on a Saturday afternoon in August. In a place you knew was a public pool. No manager, no employees, Any cars?
Halburn: There were several.

It's a 90 degree day in August (warm, you call it), yet there were no patrons at the pool. Didn't that seem a little odd to you, asswipe? Like you're the only one with the idea to go swimming.

Kaufman: Let me get back to the trespassing thing
Halburn: There was no trespass!

Kaufman: He made all that up? Nothing the sheriff said was true because he was so upset that you caught him swimming?
Halburn: I didn't catch him swimming. I walked in there to swim in a public pool with a sign that invited me in. I wasn't trying to catch anybody.
Kaufman: How can that make anyone upset unless they were nude swimming with another guy or another girl?

Kaufman: If my memory serves me most public pools are closed that last week in August because the lifeguards go back to school
.

Kaufman: Why is it that you feel you had a right or some entitlement to ask them anything- the people that were swimming?
Halburn: I thought there were people swimming in the pool.
Kaufman: There were people swimming in that pool but it was none of your concern.

Kaufman: You've got this in a picture in your mind that's very favorable to yourself that you weren't doing anything wrong.
Halburn: I wasn't.
Kaufman: That's what you think.
Halburn: That's what I know.

That's right, Pee Wee Herman, argue with the judge. That'll get you real far.

Halburn: Had that sign not been posted I would not have gone in the pool.
Kaufman: Don't you think that this is for people who pay or have a right to go in there?
Kaufman:
This is not trespassing because the sign said to go around?
Halburn: The sign says enter through the gate.
Kaufman: The gate was open & you didn't pay any money, and someone was in the pool?
Halburn: I also didn't go swimming.
Kaufman: You weren't cited for swimming.

Kaufman: He didn't look like he was there to give directions to the public did he? Honestly?
Halburn: He didn't look like an officer. He had no identification. I had no idea until he put the cuffs on me. He looked like a civilian. I thought he was joking with me.

It's all fun and games until someone gets handcuffed.
At this point I think the judge had enough and started fucking with Halburn.

Kaufman: Was he under water or above water when you asked him?Halburn: He was underwater when I first approached him and he popped up and he was above when I asked him. I didn't ask him where the manager was so I could pay, I asked him where the manager was and I would ask the manager where to pay.Kaufman: Had he taken a breath when you asked him?Halburn: I don't recall how many breaths. He appeared to have taken a breath.Kaufman: He caught one breath on his way up?Halburn: I don't know.
Kaufman: Was he in good shape, this fella?
Halburn: He appeared to... a lot of people are in shape that aren't deputies.
Kaufman: I mean he was in phenomenal shape, wasn't he?
Halburn: I wouldn't say phenomenal, but I'm not a physical fitness expert.

Halburn: He had no identification.
Kaufman: Of course he didn't, underwater?
Halburn: On his wetsuit, no identification.
Kaufman: He had a wet suit on. That should be enough.
Halburn: I've seen people swim in public pools in wetsuits.
Kaufman: 6 of 'em on an August day?

Halburn: I can see where this is going.

So do we.
Guilty
.
Again.

Halburn must read Bartlett's on a regular basis. How else could he demonstrate two adages at once. "A man who is his own lawyer has a fool for a client." and "It is better to remain silent and thought a fool than to open your mouth and remove all doubt."

He's too cheap to hire a lawyer and too stupid to keep his mouth closed.

MARK HALBURN CONVICTION UPHELD!

Kaufman Affirms Magistrate Decision
Still Guilty!

Mark Vance Halburn remains a convicted trespasser.

That's the decision of Kanawha County Circuit Court Judge Tod Kaufman who affirmed Halburn's conviction after a hearing on Wednesday, May 5th.

Halburn was convicted in January in Magistrate court in connection with a trespassing incident that occurred at the Shawnee Park Swimming Pool in Institute on August 30, 2009. He then appealed that conviction to Circuit court.

That's right folks. This is the algae filled pool Halburn wanted to swim in!

Things went bad for fatsack almost immediately when Kaufman denied all of his "motions".

Prosecutors said Halburn forced his way into the pool where the Kanawha County Sheriff Department's SWAT team was holding scuba practice, demanded to swim and when informed that the pool was closed to the public, became agitated and refused to leave.

Halburn shook his head repeatedly during Deputy J. M. Vernon's testimony as the officer stated that Halburn was ordered to leave multiple times, became aggressive and refused to remove his hands from his pockets.

The deputy also pointed out that the water was algae filled and the water level was low.
Halburn tried countering that statement by asking, "It wasn't appropriate for me but it was OK for you?"
Only Halburn would want to swim in an slimy algae pool just because someone said he couldn't.

During his testimony, Halburn, as he is wont to do, chose the fact that there was a sign that read, "Please Enter Through Side Gate"
to use as his main rebuttal point, over and over again.

Judge Kaufman would have none of that.
"You didn't pay, you didn't own the pool, it wasn't your property, there wasn't anyone there to give you permission and your whole defense was you had a right to be there because that sign was there. There was nothing to say the pool was open. That's the whole point. The fact that you can get in doesn't make it open."

PutnamLIES.com made this very point last month in our article "Halburn Pounds The Table."

In his typical sympathy ploy, Halburn repeatedly pointed out the he is a 47 year old, 300 pound (that's perjury right there) diabetic that just wanted to go swimming on a warm August day. Halburn was acting as his own lawyer and after the verbal bitchslapping he received from the judge for bringing up irrelevant matters, he seemed to be so stymied that he never brought up the "judicial misconduct" he claimed tainted his first trial. All he could do was keep babbling "the sign, the sign" in a stuttery, high pitched voice. Maybe next time maybe he should call Lee's buddy Matlock.

Ultimately, Kaufman decided Halburn had trespassed and upheld the conviction from Magistrate court.Originally, Halburn was fined $250 plus $159 in court costs. Judge Kaufman said, "Essentially you're appealing a 409 dollar and 50 cent case."
Halburn whined that the fine was excessive and Kaufman reduced it to $100 plus costs, which Halburn being Halburn, tried to argue as well. So now we'll have to hear about how he beat the system or some kind of bullshit like that.

Halburn, who is also goes by the aliases of Hallburn and the Putnam Pool Boy, calls himself the "publisher" of a cluttered internet advertising shopper in Putnam County. He also moonlights as a substitute teacher.
He has a number of previous arrests including strong arm robbery, harassment and trespassing.

Halburn Pounds The Table

There's an old saying about the law.
If you have the facts on your side, pound the facts. If you have the law on your side, pound the law. If you have neither on your side, pound the table.

Well, with his trespassing appeal Halburn is pounding the table.
As much as Halburn has been in court, you'd think he'd know how it works.
Precedent.
A judge wants to know what past cases show that the law wasn't followed in this trial.
Not that the judge hurt your feelings or had a bad attitude.

Personally attacking the judge that found you guilty isn't going to help you either.

And your insistence that the law says that you get a whole new trial is ABSOLUTELY wrong.

Let's look at just what the law does say:

WEST VIRGINIA CODE §50-5-13.

(4) The circuit court may take any of the following actions which may be necessary to dispose of the questions presented on appeal, with justice to the defendant and the state:

(A) Dismiss the appeal;

(B) Reverse, affirm, or modify the judgment or order being appealed;

(C) Remand the case for further proceedings, with instructions to the magistrate;

(D) Finally dispose of the action by entering judgment on appeal; or

(E) Retain the matter and retry the issues of fact, or some part or portions thereof.

Those are the the choices Judge Kaufman has. Don't count on (E) to be his decision.
We're betting on (A).

And then where are you going to go?
The Supreme Court?
Oh, that's right, you can't go there because you're banned from there for making threats on employees.

Now, let's look at that "motion", shall we?

CAUSE FOR REVERSAL ONE:
Improper consideration of outside evidence by magistrate.

During Magistrate Carper-Strickland's verdict comments, she stated that "These deputies are road deputies'" and indicated that she did not believe they were In un-marked cars, which I testified. That
comment about being Road deputies'" was not part of the deputy's testimony. Carper-Strickland's statement indicates that she used personal knowledge from outside the courtroom in reaching her
verdict. Because of this, there is NO CHOICE but to reverse the verdict and to IMMEDIATELY remove Carper-Strickland from the bench for GROSS MISCONDUCT!

The bullshit starts from the get go.
Both deputies Vernon and Gaddy are "road deputies". That's what they do. Other than court bailiffs and Sheriff Department administrators, that's what every deputy does. Gets in a cruiser and patrols the roads.
Keeping your fat ass safe from the criminals and perverts that you're obsessed with. As well as protecting you from the people that would like to whip your ass. This day however, they were participating in swimming training for the SWAT team. Doesn't change their job. They're road deputies.
Same as her knowing the difference between a beat cop and a detective.

CAUSE FOR REVERSAL TWO: Hostile environment.
From moment one, Carper-Strickland was extremely hostile, arrogant, condescending, and rude to me.
When I produced a copy of a motion that she did not have, at first she did not believe me, despite a court stamp. And she rudely (and improperly) scolded me for taking up a clerk's offer to forward a motion to the prosecutor. This despite the fact that there is a mailbox in the magistrate clerk's office set aside for documents to be forwarded to the prosecutor's office. Then she said "I will take care of this problem.'" News bulletin: The problem is that the prosecutor's office is blocks away with no public parking, including a lack of parking in front of the building. And the other problem is that Carper-Strickland's attitude and conduct was gross misconduct.

Not what the Supreme Court says:
"mere inefficiency, unsatisfactory conduct, failure in good performance as the result of inability or incapacity, inadvertencies or ordinary negligence in isolated instances, or good faith errors in judgment or discretion are not to be deemed "misconduct"."

CAUSE FOR REVERSAL THREE: Refusal to believe legitimate evidence. During my testimony, I presented a color photo of a sign that was on the door of the pool office. This photo of the sign which directed me to enter through the side gate was key to my case. Carper-Strickland said she flat out did not believe that the photo was legitimate. I presented this under oath. Carper-Strickland's refusal to believe physical evidence (because she obviously simply did not want to) is grounds for reversal of her guilty verdict and grounds to remove her from the bench and criminally prosecute her for gross misconduct.

You presenting evidence doesn't make it true. A picture could be taken anytime and is not evidence of anything. The judge looks at the evidence and determines what's credible.

What were you doing anyway? Driving down the road and thought, "It's hot, I'll think I'll stop in at a pool that's 20 miles from my house for a cool dip?"
Aren't there pools in Putnam County? Or are you banned from all of them?

A business that has a sign that says "Use Side Door" doesn't mean you can break that door down and go in when they're closed.

CAUSE FOR REVERSAL FOUR: Violation of 14th Amendment Equal Protection Rights Violation
I presented a motion for dismissal because my magistrate court case was not heard under the same fall term as Circuit Court cases; my 14th Amendment rights were clearly violated. carper-Strickland ignored this and railroaded me into a guilty verdict by denying my legitimate motion for dismissal. It was obvious that Carper-Strickland did not want to hear my argument and more obvious that she has no understanding of the 14th Amendment and its Equal Protection clause. In fact. I doubt that she has ever read the 14th Amendment.

Back to beating that 120 day horse again?
It was 170 days, not excessive.

WV Code 62-3-1 says:
"When an indictment is found...the accused shall be tried at the same term."

You, dipshit, were not indicted.

Here's what the court says:

For magistrate court misdemeanors, State ex rel. Stiltner v. Harshbarger, 170 W.Va. 739, 296 S.E.2d 861 (1982), is the leading case on when a defendant can move to dismiss due to an unreasonable delay. There are two rules set forth in this case: (1) the defendant must be brought to trial within one year; and (2) if the defendant is in jail or has requested a speedy trial, (s)he should be brought to trial within 120 days, unless the trial is continued for good cause.

If you wanted a speedy trial you should have filed a motion for a speedy trial. Not doing so makes it impossible for you to argue the delay.

CAUSE FOR REVERSAL FIVE: Refusal to recuse
Despite my filing of a motion to recuse based on a LEGITMATE conflict of interest within Carper's family, she refused to recuse herself. Even the PERCEPTION of a conflict was enough for grounds for recusal. Her arrogant refusal to recuse shows her misconduct. The best thing to do in a conflict of interest Is to walk away from the case and to hand it to an impartial magistrate. She called my request "absurd'" yet it is her refusal to recuse that is absurd. And her trial misconduct and comments and guilty verdict were ultimately absurd. Carper-Strickland's refusal to recuse is also grounds for reversal of her absurd guilty verdict and grounds for her IMMEDIATE removal from the bench and prosecution for GROSS MISCONDUCT.

Your motion for recusal says nothing about a conflict with any of Carper's family. All you show is a name on some on-line petition. Anyone could have signed that. You could have signed his name.
Your name on the NAMBLA site doesn't mean you actually support them.
She had no reason to recuse herself.

And smooth move criticizing this decision because it was ultimately approved by the judge you'll be going before in your appeal. It's like calling him a moron.

CAUSE FOR REVERSAL SIX: Carper allowed the incredible testimony of Deputies Gandy and Vernon who showed the largest case of "selective memory known to man. In addition to lying about giving me "five seconds" to leave the pool area, Vernon could not remember the color of my car (which he entered) as well as other key elements of what happened that day. His statement that he was conducting "Classified" training in a PUBLIC pool behind an UNLOCKED and UNPOSTED gate was astoundingly incredible. Richard Nixon, Charles Manson, and Richard Ramirez have more credibility than Gandy and Vernon. Carper-Strickland should have banished both from her courtroom instead of believing either or both. The fact that she allowed them both to testify is grounds for reversal of my verdict, IMMEDIATELY banishing her from the bench, and criminally prosecuting her.

What color your car is has no bearing on this case. Your car didn't trespass at the pool. His statement that he was conducting "Classified" training may have been incredible but it was true.

And you left Hitler and the Ayatollah off your list.

CAUSE FOR REVERSAL SEVEN: Failure to forward appeal.
On January 27th, 2010, IMMEDIATELY following Carper-Strickland's false guilty verdict. I signed appeal
paperwork. On February 10th, I contacted the Magistrate Clerk's office to learn the hearing date and the name of the judge that it was assigned. I was told to contact circuit court because the case had been moved to circuit court. When I did, a clerk named Darla told me the case had not been forwarded. She also stated that the magistrate court regularly failed to forward appeals. Because my case was not properly forwarded, my right to a speedy appeal has been violated. The head magistrate clerk was not available, nor was the head court administrator, despite my call DURING NORMAL BUSINESS HOURS! (Why weren't these employees at work during business hours?) Again, this is grounds for dismissal of my case, reversal of verdict, and IMMEDIATE removal of Carper-Strickland and criminal prosecution. Obviously, with the above facts, my civil rights have been irrevocably violated by Carper-Strickland and the Kanawha County Magistrate Court's gross misconduct. There is no choice but to reverse my false guilty verdict and to IMMEDIATELY remove Carper-Strickland from the bench and to do the same with the magistrate clerks and the court administrator. They then should be aggressively prosecuted for their GROSS MISCONDUCT.

You have 20 days to file an appeal. It took 10 days for them to forward the paperwork. There's no delay there. You didn't file this motion until the 17th.
Again, you did not file a speedy trial motion so you lose on this one.

Someone there not taking your calls? Those people over there are busy. Not available doesn't mean they weren't there. When did you call? Maybe they were at lunch.

There was no "false guilty verdict". You were found guilty of trespassing in a court of law. Period. Nothing false about it.

CAUSE FOR REVERSAL EIGHT: Excessive fine
The fine of $250 is exorbitant and excessive. It is out of line for most trespassing fines and again shows
Carper-Strickland's bias against me. It should be reduced to ZERO and instead, SHE should be fined, banished from the bench, and CRIMINALLY prosecuted. Her style of "justice" is a travesty to the court and a ripoff of the taxpayers of West Virginia. Furthermore, several elements of the fine are Regional Jail costs, and I was NOT an Inmate of the regional jail system. It is illegal to charge people for services that they did not receive. However, I have NO OBJECTION to Carper-Strickland being incarcerated in South Central and fined for her stay!

You could have been fined $500 AND gotten 6 months in jail. You got off easy, shitbag.

The Regional Jail fee is something everyone pays when they pay a fine. It's a law that was passed to help fund the jails. You have a problem with that take it up with the Legislature.

You know what I didn't see in any of this?
Anything showing ANY respect for the court. No respectfully request, prays, or or any language like that.

It's all NO CHOICE, GROSS MISCONDUCT, IMMEDIATE removal, aggressively prosecuted, etc, etc. with you.

What exactly should she be prosecuted for? Name the law she broke.
Not kissing Mark Halburn's fat ass is not a crime in West Virginia.

And you know something else? If you had any sense, you'd have asked for a jury trial. The likelihood of an acquittal is always greater before a jury than it is before
a magistrate.
Maybe you'd have gotten off but you knew
they'd probably convict you anyway and you'd have to pay a jury fee. Once again, your cheap bastardism comes into play.

You're grasping at straws here. You're like the guy that gets a speeding ticket and then tries to get out of it by saying the cop wasn't wearing his hat.

The bottom line here is the pool was closed. You were told the pool was closed yet you continued to try to bull your way in.
You picked the wrong day and fucked with the wrong person.

The pool's closed, bitch.
You're going to get your ass handed to you in court and we're going to be there to see it.

Halburn Appeal Slated

Putnam Pool Boy to Appear In Court May 5

Mark Vance Halburn (alias Hallburn) has appealed his January trespassing conviction to Kanawha County Circuit Court.

CONVICTED TRESPASSER

Hallburn was found guilty of trespass charges i
n a hearing before Kanawha County Magistrate Traci Carper-Strickland on January 27 of this year stemming from an August 30, 2009 incident at the Shawnee Park pool in Institute WV.
He was fined $250 plus court costs of $159.50.

Halburn's appeal alleges gross misconduct on the part of Carper-Strickland, whatever that is. Apparently the magistrate hurt Li'l Marky's feelings. That's not grounds for anything in any court in the land.
The rest of the appeal is nothing more than a personal attack on Carper-Strickland.
The case has been assigned to Chief Kanawha Circuit Judge Tod Kaufman and will be heard on Wednesday May 5 at 8:30 AM.
Once again, the public is urged to attend.
Kaufman has several options in this case. He can find there are no grounds for appeal and dismiss the case, hear the appeal in circuit court or remand the case back to magistrate court.

Halburn is representing himself and as we all know, " A man who is his own lawyer has a fool for a client."

Halburn calls himself the "publisher" of a cluttered internet advertising shopping blog in Putnam County. He also moonlights as a substitute teacher.
He has a number of previous arrests including robbery and trespassing.

PutnamLIES.com will have more on this story as it becomes available.
We will also have full coverage of the trial when it happens.

This Is The City

Charleston, West Virginia.

It's the capital of West Virginia. It's a great place to live and work.
There are lots of things to do here.

You can take in a baseball game,

go for a hike in the forest,

or go boating on the river.

There's plenty of space for everybody here, both public and private.
Most West Virginians respect the law and other people's property.
When they don't, I go to work. I carry a badge.

It was Sunday, August the 30th. It was hot in the Kanawha Valley. The boss is Mike Rutherford. My name's Vernon.
I was on a department scuba training at the Shawnee golf course pool. The pool had been closed to the general public for a long period of time and had been made available for our training.

While in the pool training, I observed a white male approach and enter the pool area through a closed and posted gate. The male, later identified as Mr. Mark Halburn, came through the gate and into the pool area.
At this time I identified myself as a Kanawha County Sheriff deputy and asked how I could help Mr. Halburn.
Halburn immediately became defensive as he raised his voice and demanded that he was "going to swim". I attempted several times to explain to Halburn that this facility was closed and that we were training. Halburn refused to comply with multiple requests to leave the pool area.
He became agitated and continued to walk toward us at an elevated position in pool area with his hands in his pockets. Halburn continued to refuse to leave the area as he demanded that he was going to swim in this pool regardless because we were.
Halburn was cited for trespassing and had to be escorted off the property by law enforcement.

On January 27th 2010, trial was held in Magistrate Court of Kanawha County.
The defendant, Mark Vance Halburn was found guilty of trespassing. He was fined $250 plus an additional $159.50 in court costs. The case is now pending appeal.

Publisher’s note: The above is taken directly from the criminal complaint in the case of State of West Virginia v. Mark V. Halburn. Kanawha County case 09m-10170.
A criminal complaint is a legal document that is usually filled out by a law enforcement officer presenting evidence to a judge or magistrate. The judicial official determined that the evidence presented in this case was enough to convict. The defendant is now considered guilty since he was convicted in a court of law.

GUILTY!

HALBURN CONVICTED!

The Putnam Pool Boy, Mark Halburn, alias Mark Hallburn, was convicted Wednesday in Kanawha County Magistrate Court of trespassing.
In a hearing before Magistrate Traci Carper-Strickland, Hallburn was found guilty of trespass charges stemming from an August 30, 2009 incident at the Shawnee Park pool in Institute WV.
He was fined $250 plus court costs of $159.50.

You lose, bitch!

When asked after the decision what he was going to do next, Halburn stated, "I'd like to go to Disney World, but that's out of the question, so I'll start loosening up my sphincter for when I go to the sneezer. Maybe a road cone will work."

Good luck getting this one expunged, fatboy.

Halburn
said he's going to appeal due to magistrate misconduct. Whatever that is.
We look forward to the appeal (if granted, which is unlikely) so we can fully cover the new trial. We will be on it like stink on the shit that he is.

PutnamLIES.com will have continuing coverage of this story as it becomes available.

Kanawha County Deputy J. M. Vernon says Mark Vance Halburn, alias Mark Hallburn, was trespassing in August of 2009, and now the date has been set for Halburn to face the music.

Halburn's trial has been scheduled for January 27, 2010, at 10 AM before Kanawha County Magistrate Traci Carper-Strickland. The public is invited to attend.

According to a citation issued by Vernon, Halburn was busted after after forcing his way into the swimming pool at Shawnee Park in Institute on August 30, 2009. After refusing to leave, Halburn was arrested. Unfortunately for him, the Kanawha County Sheriff Department SWAT Team was conducting exercises there at the time. Halburn is charged with a misdemeanor.

Halburn is the "Publisher" of PutnumLive.com, an internet blog. He also claims to be a journalist. He was not on duty at the time of his arrest.

PutnamLIES.com readers may recall that we broke the story of the arrest immediately after it happened. The EXCLUSIVE STORY detailed the circumstances surrounding the crime.

EXCLUSIVE - PUTNAM POOL BOY ARRESTED AGAIN!

Halburn Tresspassing Ticket

Here we go again!
PutnamLIES.com has obtained exclusive access to not-so-shocking news. The Putnam Pool Boy, Mark Halburn (aka Hallburn) has struck again.
This is a story that you'll never see on PutnamLive.com.
Kanawha Pool
In the latest chapter of "harass him so he shuts up," Putnam County Parks and Recreation has conspired with Kanawha County and had me arrested for trespassing at the Shawnee Park Pool in Institute WV.

On Sunday, August 30, 2009 I entered the premises while it was closed DURING POSTED BUSINESS HOURS and demanded to swim, just like I did at the County Park Pool in Eleanor last summer.
They told me that the pool was closed but then I showed the IDIOT a sign that said the pool was scheduled to be open until 6 p.m. They said it had closed early that day and told me numerous times to leave. How RUDE!!
But I got in their face, and told them I was not leaving.
I then told them to get the parks director on the phone and tell him to send in his RESIGNATION.

HAH! I'll show them to screw with me. I'm a JOURNALIST!

Usually they have a teenager that I can bully easily , but who was there using the pool?

A SWAT team from Kanawha County!!!!
Swat team
Holy fuck! I'm not ashamed to say I SHIT MY PANTS right then and there. What a mess!
Since they were men AND cops, I didn't try to intimidate them, but groveled and cried like a little bitch instead.
That bastard J. M. Vernon arrested me for trespassing anyway and I was arraigned in front of Kim Aaron and had to post bail.Halburn court form
Even though I'm not on Facebook anymore, I'm glad Kim Aaron is still my friend. She was the one that let me off on my other pool trespassing charge.
Mess with me will you? I've got friends in the Judicial system.

It's obvious to me now that the tentacles of the corrupt Putnam County government are so powerful and pervasive that they cross county lines in order to get Kanawha County to harass me.

Halburn mug shotNOT my mugshot... this time.

What's next? After another embarrassing trial where I'll plead insanity, I plan to draft another groundless multi-million dollar claim against the Kanawha County Sheriff's Department, Parks and Recreation Department and that pompous bastard Kent Carper. Like dogshit on the sole of a shoe, they smeared my good name. I look forward to seeing them in civil court - if I can get a lawyer that I haven't alienated to take my case on a contingency basis. The Kanawha County Sheriff's office was unavailable for comment, but we invite them to contact PutnamLIES.com.

Keep reading PutnamLIES.com for further coverage of this case.

PutnamLIES.com would not be able to bring you this story if it happened in Putnam County because Sheriff Mark L. Smith and his administration refuse to return my harassing telephone calls after this publisher was acquitted after an allegedly false arrest last year and filed yet another baseless claim for damages against the department.
For more than 6 months, Sheriff Smith has been uncooperative about providing crime reports and has refused to return my annoying phone calls. They're all INCOMPETENT jackasses. Why won't they treat me like the media professional that I am?
Due to my douchbaggery, PutnamLIES.com was forced to file a Freedom of Information Act request with the department in order to view crime reports. As soon I stop behaving like a whiny little bitch PutnamLIES.com will be able to bring you crime news more promptly.
Maybe not always acting like an asshole, treating people with respect and without name calling would work better than calling people corrupt idiots.
Naaaah.
